Terms of Service
Last updated: March 2026
1. Acceptance of Terms
By accessing and using DepositBack ("the Service"), you accept and agree to be bound by these terms and conditions. If you do not agree to these terms, please do not use this service. These terms constitute a legally binding agreement between you and DepositBack.
2. Eligibility
You must be at least 18 years old to use this service. By using DepositBack, you represent and warrant that you are at least 18 years old and have the legal capacity to enter into these terms. Our service is designed for tenants in England and Wales only and may not be suitable for tenancies in other jurisdictions.
3. Description of Service
DepositBack is a digital document generation and information tool. We provide personalised dispute documents (demand letters, evidence checklists, dispute timelines, and related materials) based on information you provide about your tenancy deposit dispute. Our service is classified as digital content under the Consumer Rights Act 2015.
4. Pricing and Payment
Prices for our products are displayed on our pricing page and at the point of purchase. All prices are in British Pounds (GBP) and include VAT where applicable. Payment is processed securely by Stripe. We reserve the right to change our prices at any time, but changes will not affect orders already placed and paid for.
5. Digital Content and Your Statutory Rights
Our products are digital content supplied to you immediately upon purchase. Under the Consumer Rights Act 2015, digital content must be of satisfactory quality, fit for a particular purpose, and as described. If our digital content is faulty or not as described, you are entitled to a repair or replacement, and if the fault cannot be fixed, you may be entitled to a full or partial refund.
By purchasing and immediately accessing your documents, you acknowledge that you are requesting immediate access to digital content and that once the documents have been generated, you lose your right to cancel under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, except where the digital content is faulty.
6. Document Quality Guarantee
In addition to your statutory rights, we offer a Document Quality Guarantee. If your documents contain factual errors based on the information you provided, or are not properly tailored to your specific situation as described in your questionnaire answers, we will either correct the documents or provide a full refund at our discretion. To make a Document Quality Guarantee claim, contact us within 30 days of purchase with details of the issue. This guarantee does not cover the outcome of your dispute — only the quality of the documents we generate.
7. Use License
Upon purchase, you are granted a non-exclusive, non-transferable licence to use your generated documents for your personal deposit dispute only. You may not:
- Resell, redistribute, or commercially exploit the documents or templates
- Use the materials for any commercial purpose or public display
- Attempt to reverse-engineer our document generation system
- Remove any proprietary notices from the materials
- Share your account or purchased documents with others for their disputes
8. Your Responsibilities
You are responsible for: providing accurate and complete information in the dispute questionnaire; reviewing all generated documents for accuracy before using them; ensuring the documents are appropriate for your specific situation; meeting any applicable time limits or deadlines for your dispute; and seeking independent professional legal advice where necessary. We generate documents based on what you tell us. If you provide inaccurate or incomplete information, the documents may not serve your needs.
9. Disclaimer — NOT LEGAL ADVICE
DepositBack is a document generation and information tool only. We are not a law firm, solicitor service, or claims management company. We are not regulated by the Solicitors Regulation Authority or the Financial Conduct Authority. The materials on this website are for information purposes only and should not be construed as legal advice. You should consult with a qualified solicitor before taking any action based on information provided by DepositBack.
Please read our full Legal Disclaimer for complete details.
10. Limitation of Liability
To the maximum extent permitted by applicable law, DepositBack shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total aggregate liability for any claim shall not exceed the amount you paid for the specific product giving rise to the claim.
Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; or any other liability that cannot be excluded or limited under English law. Your statutory rights under the Consumer Rights Act 2015 are not affected by these terms.
11. Intellectual Property
All content on the DepositBack website — including text, templates, design, logos, and code — is the intellectual property of DepositBack and is protected by copyright law. The personalised documents generated for you are licensed for your personal use as described in section 7 above.
12. External Links
Our website may contain links to third-party websites (including deposit protection schemes, Citizens Advice, and Shelter). We are not responsible for the content, accuracy, or practices of any linked site. Inclusion of a link does not imply endorsement.
13. Modifications to Terms
We may update these terms from time to time. Material changes will be posted on this page with an updated "Last updated" date. Continued use of the service after changes constitutes acceptance of the revised terms. Changes will not affect orders already placed and paid for under previous terms.
14. Complaints and Disputes
If you have a complaint about our service, please contact us first. We will try to resolve your complaint within 14 working days. If we cannot resolve your complaint to your satisfaction, you may be able to use the European Commission's Online Dispute Resolution platform or seek advice from Citizens Advice.
15. Governing Law
These terms and conditions are governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these terms or your use of the service shall be subject to the exclusive jurisdiction of the courts of England and Wales. Nothing in these terms affects your statutory rights as a consumer.
